TCPA Compliance & SMS Consent

1. What Is the TCPA?

The Telephone Consumer Protection Act (TCPA) is a federal law that regulates automated telephone calls, prerecorded messages, and text messages. It requires businesses to obtain prior express written consent before sending marketing communications using automated systems, and restricts when and how those communications may be made. TradesCallPro takes TCPA compliance seriously. This page explains how we use automated communications and what consent standards apply.

2. How TradesCallPro Uses Automated Communication

Inbound calls: Kayla answers INBOUND calls from your customers — your customers call you, and Kayla answers on your behalf using an AI voice assistant. We do not initiate outbound automated marketing calls to your customers. Operational SMS: TradesCallPro sends SMS messages to you (the business owner) and your workers for operational purposes — job bookings, schedule changes, worker alerts, payment notices, emergency dispatch, and account notifications. These are transactional communications necessary to operate the platform, not marketing messages. We do NOT use automated dialing systems for outbound marketing calls or unsolicited marketing texts to your end customers under any circumstances.

3. Business Owner and Worker SMS Consent

Prior express consent: By creating a TradesCallPro account, you provide prior express written consent to receive recurring automated SMS messages from TradesCallPro related to: • Account setup and onboarding • Job bookings and schedule changes • Worker clock-in/out alerts • Payment and receipt notifications • Emergency dispatch alerts • Service updates and billing notices These messages are essential to the operation of the platform. Your consent is a condition of using the service. Message frequency varies based on your account activity. Message and data rates may apply depending on your mobile carrier and plan. You may revoke consent at any time by replying STOP to any message. Reply HELP for help. After you reply STOP, we will stop sending SMS to that number (note: critical alerts such as emergency dispatch will then be delivered only via the dashboard and email). Mobile opt-in data and consent are never shared with or sold to third parties.

4. Customer Call Consent and AI Disclosure

When a customer calls your Kayla-answered phone number, Kayla delivers a verbal disclosure at the beginning of every call stating that: • The call may be recorded for quality and training purposes. • The call is being handled by an AI assistant. By remaining on the call after this disclosure, the customer acknowledges the AI-assisted and recorded nature of the call. As the business owner, you are responsible for ensuring that your phone number listings, website, and marketing materials inform customers that calls may be answered by an AI assistant and may be recorded. TradesCallPro provides the technical disclosure on every call, but you bear responsibility for any additional consent requirements under the laws of your jurisdiction and your customers' jurisdictions. For marketing texts you send to your own customers outside of TradesCallPro: you must independently obtain prior express written consent compliant with TCPA before sending any automated marketing messages. TradesCallPro's platform does not currently send marketing messages to your end customers on your behalf.

5. Required CTIA Disclosures

The following standard disclosures apply to all SMS communications from TradesCallPro: • Message and data rates may apply. • Message frequency varies based on your account activity. • Reply STOP to opt out of SMS messages at any time. • Reply HELP for help or contact legal@tradescallpro.com. After you reply STOP, you will receive a single confirmation message and no further SMS except as required by law.

6. How to Revoke Consent

You may revoke your consent to receive SMS messages at any time using any of the following methods: • Reply STOP to any SMS message from TradesCallPro. • Contact us at legal@tradescallpro.com with a written revocation request. • Update your notification preferences in your account settings. Revoking SMS consent does not affect your right to use the service. Critical notifications will be delivered via email and the dashboard instead.
